Attention is essential to the practice of medicine. It is required for expert and timely diagnoses and treatments, is implicated in the techniques and practices oriented toward healing, and enlivens the interpersonal dimensions of care. Attention enables witnessing, presence, compassion, and discernment. The French philosopher and activist Simone Weil (1909–1943) developed one of the most original and important descriptions of attention in the last century. For Weil, attention is not an attitude of strained focus but of perceptive waiting (...) that leads to the acquisition and integration of knowledge. Contrary to activities often foregrounded in clinical medicine, it requires renunciation of the will, gentle directedness toward the origin of actions, and diminishment of the self. This paper critically examines Weil’s concept of attention as it applies to health systems, technical/intellectual work, and interpersonal care, as well as its connection to theology, and considers whether attention might find a home within the contemporary clinic. Professor Weil’s thesis seems largely correct with respect to the United States, whose law on religious establishment I regularly teach. Funding is central to American debates over religious establishment. The fight over religious establishments in Virginia, which inspired both James Madison’s “Memorial and Remonstrance against Religious Assessments” and Thomas Jefferson’s “An Act for Establishing Religious Freedom,” was over whether persons could be forced to pay taxes to support religious instruction. Financial concerns were at the root of church-state debates in (...) the nineteenth century, when Protestants repeatedly rebuffed Catholics who wanted funding for Catholic private schools. Many state constitutions still have what are known as mini-Blaine Amendments that forbid public funding for religious institutions. Whether proponents of a strong separation between church and state in the United States are fighting the same battles as proponents of a strong separation of church and state in France is nevertheless problematic. The French revolutionaries had to subordinate a reactionary church. The American revolutionaries merely had to negotiate peace treaties among the different sects that supported the Declaration of Independence. Separation of church and state in the United States is best conceptualized as a division of labor among liberal institutions rather than a means for purging anti-liberal religion from the liberal public sphere. For Kant, moral evil of all sorts - evil that is rooted in a person's character - is manifested in action which, on the one hand, is explicable in terms of an agent's own reasons for action and so imputable, though on the other hand it is, in some sense, irrational. Because such evil is rooted in a person's character, it "corrupts the ground of all maxims" and thus deserves to be called radical evil. Moreover, according to Kant, not only (...) are human beings susceptible to such evil, being evil is an inescapable condition of being human. These claims raise a number of questions, among them the following: How can we ecxplain the possibility of irrational, yet explicable, freely done actions given Kant's views about human agency? What is the nature of radical evil? In what sense is it a corrupting ground of all maxims? What reason does Kant have for claiming that radical evil is an inescapable part of the human condition? In this paper, I focus on these questions. Sections I and II are concerned with some basic themes and distinctions pertaining to Kant's theory of action and practical rationality that will provide a basis for understanding his view of moral evil. In section III, I turn to Kant's analysis of moral evil in its varios manifestations in order to provide, in section IV, a general charcterization of moral evil. In section V, I consider Kant's claim that radical evils corrupts the ground of all maxims, and what this claim implies about the possibility of actions having moral worth. In section VI, I want to consider what we can call Kant's Universality Thesis, viz., his claim that necessarily all human beings are radically evil. In his recent book, Kant's Theory of Freedom, Henry Allison has argued that the UT represents a synthetic a priori claim, and he proceeds to provide a 'deduction' for it, something that Kant failed to do. I argue that Allison's deduction does not work, though I am afraid I don't have a deduction of my own to propose on Kant's behalf, nor do I see how to reconcile Kant's own defense of the UT with its alleged a priori status. Kant's UT remains problematic. Für Kant manifestiert sich das moralisch Böse in allen seinen Varianten - das Böse nämlich, das im Charakter einer Person wurzelt - in Handlungen, die auf der einen Seite vom eigenen Standpunkt des Handelnden her expliziert werden können und die deshalb zurechenbar sind, die aber auf der anderen Seite in einer gewissen Hinsicht als irrational bezeichnet werden müssen. Weil das Böse im Charakter der Person wurzelt, "verdirbt es den Grund aller Maximen" und verdient deshalb "das radikal Böse" genannt zu werden. Darüber hinaus sind menschliche Wesen nach Kant nicht nur für das Böse anfällig, es ist vielmehr unentrinnbar menschliches Schicksal, böse zu sein. Diese Thesen werfen eine Reihe von Fragen auf, unter ihnen die folgenden: Wie läßt sich, Kants Auffassungen über die Natur menschlichen Handelns vorausgesetzt, die Möglichkeit irrationalen, aber gleichwohl vom Standpunkt des Handelnden her explizierbaren und also freien Handelns erklären? Abschnitt III wendet sich Kants Analyse des moralisch Bösen in seinen verschiedenen Ausprägungen zu, um auf dieser Grundlage eine allgemeine Charakterisierung des moralisch Bösen geben zu können. In Abschnitt VI geht es um das, was man "Kants Universalitätsthese" nennen kann, d.i. seine Behauptung, menschliche Wesen seien notwendigerweise radikal böse. This paper asks questions about 'trauma' and its cultural representation specifically, trauma's representation in the cinema. In this respect, it compares and contrasts the work of Robert Bresson, in particular his 1967 masterpiece, Mouchette , with contemporary Hollywood film. James Mangold's 1999 'Oscar-winning' Girl, Interrupted offers an interesting example for cultural comparison. In both Mouchette and Girl, Interrupted the subject matter includes, amongst other traumatic experiences, rape, childhood abuse and suicide. The paper ponders the question of whether such aspects of (...) trauma can ever be authentically represented on film; or, whether, on the contrary, through the deployment of cultural stereotypes, cinematic representation tends rather to reproduce the very forms of structural power which are, in the first place, trauma's primary cause. Bresson emerges from this analysis in a favourable light for, whereas Mangold stereotypes victims of trauma and represents traumatic experience itself as inevitable and over-determined, Bresson always retains for the victim a sense of critical agency. By contrasting key scenes from both films, the paper suggests that contemporary popular cinema (the 'Hollywood-ized' form), working in tandem with institutions of social control, such as psychiatry, does not subvert but, in fact, reproduces patterns of structural power. This argument has particular significance for the cultural representation of women. The paper is theoretically framed by Simone Weil's reflections on both 'representation' and 'structural power'. In this essay, I offer a utilitarian perspective on humanitarian intervention. There is no generally accepted precise definition of the term ‘humanitarian intervention’. I will provisionally, and roughly, define humanitarian intervention as the use of force by a state, beyond its own borders, that has as a purpose or an effect the protection of the human rights of noncitizens or the reduction of the suffering of noncitizens.

Abstract:Extrapolating from Carroll’s four domains of corporate social responsibility (1979) and Pyramid of CSR (1991), an alternative approach to conceptualizing corporate social responsibility (CSR) is proposed. A three-domain approach is presented in which the three core domains of economic, legal, and ethical responsibilities are depicted in a Venn model framework. The Venn framework yields seven CSR categories resulting from the overlap of the three core domains. Contrary to Constantin Fasolt, I argue that it is no longer useful to think of religion as an anomaly in the modern age. Here is Fasolt’s main argument: humankind suffers from a radical rift between the self and the world. The chief function of religion is to mitigate or cope with this fracture by means of dogmas and rituals that reconcile the self to the world. In the past, religion successfully fulfilled this job. But in modernity, it fails to, and (...) it fails because religion is no longer plausible. Historical, confessional religions, then, are no longer doing what they are supposed to do; yet the need for religion is still very much with us. Fasolt’s account would be a tragic tale, if not for his claim that there is a new religion for the modern age, a religion that fulfills the true reconciling function of religion. That new religion is the reading and writing of history. Indeed, for Fasolt, reading history is religiously redemptive, and writing history is a sacred act. The historian, it turns out, is the priest in modernity. In my response, I challenge both Fasolt’s remedy and its justification . Indeed, I reject both his romantic view of past religion as the peaceful reconciler, as well as his pessimistic view of present religion as the maker of “enemies” among modern people. In the end, I argue that the way Fasolt employs his categories—“alienation,” “salvation,” “religion,” “history”—is too vague to do much useful work. They are significant categories and they deserve our attention. But in my view, the story Fasolt tells is both too grim and too cheerful. (shrink)

In this article, we use a corporate social responsibility (CSR) framework to analyze the payday loan industry by critically examining its practices from an economic, legal, and ethical perspective. Payday loans are essentially a very high cost, unsecured, short‐term personal loan. Given the inherent nature of the product being offered, the industry appears on the face of it to be in a position to potentially exploit vulnerable consumers in pursuit of profits. With this concern in mind, our analysis investigates the (...) following three issues: Can the payday loan industry currently be considered to be acting in a socially responsible manner? If the industry cannot be considered to be socially responsible, should it be further regulated? If the industry should be further regulated, how should it be regulated? To address these issues, we first provide a brief historical overview of payday loans. Second, we describe the important characteristics of payday loans and how the industry operates. Third, we draw on various sources of evidence to demonstrate that the payday loan industry, while fulfilling its basic economic obligations, falls outside of both the legal and ethical domains of the Three Domain Model of CSR. Based on our analysis, our conclusion is that the payday loan industry requires additional government legal regulation, particularly with respect to allowable fees, and we conclude that there is a strong ethical case for banning payday loans altogether. Thomas W. Dunfee, in addition to his many other contributions to business ethics literature, has generated a stream of research that attempts to tackle the issue of corruption. Dunfee's research on corruption includes three primary contributions: the introduction of "Integrative Social Contract Theory" which provides a normative theoretical framework by which to judge the morality of global business activity including corruption; the "C2 Principles", which outline specific content and implementation measures that corporations can voluntarily adopt to combat corruption; and a (...) normative evaluation of "guanxi," a concept which can lead to questionable corruption practices in China. The article will highlight Dunfee's contribution to the literature and suggest future research directions based on his academic work. (shrink)

In this article we examine the association between corporate social responsibility (CSR) and firm value. This line of research is important since firms continue to invest in CSR even though past studies reveal a limited linkage between financial value and CSR. However, the business case for CSR or “doing good while making a profit,” appears to be advancing within the business ethics literature as a preferred conception of CSR. We conjecture that the greater unification and refinement of both profit maximization (...) and stakeholder interests through corporate acts, not statements alone, will sustain the financial value of CSR in a less regulated global business environment. We study the triangle of what companies say, what companies do, and firm financial performance. We analyze Fortune 250 firms and find a positive association between what companies do based on KLD Research and Analytics, Inc. (KLD) ratings, and what companies state about ethics in their CSR statements. We then employ regression analysis and find that companies’ socially responsible acts are positively associated with overall firm value and financial performance. Yet we do not find a statistically significant association between what companies say regarding ethics in their CSR statements and their financial outcomes. These results suggest that firm value and financial performance is associated with what companies do and not what they say. Our results seem to be driven by multinational corporations (MNCs) and not by non‐MNCs. This is possibly because MNCs generally operate in a less regulated global business environment that often necessitates strong ethical corporate leadership to further stakeholder interests. Overall, these results help reconcile corporate and stakeholder objectives since evidence of a link between financial performance and doing good sustains global CSR. (shrink)

This paper attempts to build on the contribution to moral imagination theory by Patricia Werhane by further integrating moral imagination with new theoretical developments that have taken place in the business ethics field. To accomplish this objective, part one will review the concept of moral imagination, from its definitional origins to its full theoretical conceptualization. Part two will provide a brief literature review of how moral imagination has been applied in empirical research. Part three will analyze and apply the construct (...) of moral imagination as it relates to the key process stages of ethical decision making including awareness, judgment, intention, and behavior. Immoral imagination is then discussed, along with other behavioral ethics concepts as they relate to moral imagination. The paper concludes with potential future research directions, as well as teaching and managerial implications for the moral imagination construct. (shrink)

The relationship between the canonical operator and the path integral formulation of quantum electrodynamics is analyzed with a particular focus on the implementation of gauge constraints in the two approaches. The removal of gauge volumes in the path integral is shown to match with the presence of zero-norm ghost states associated with gauge transformations in the canonical operator approach. The path integrals for QED in both the Feynman and the temporal gauges are examined and several ways of implementing the gauge (...) constraint integrations are demonstrated. The upshot is to show that both the Feynman and the temporal gauge path integrals are equivalent to the Coulomb gauge path integral, matching the results developed by Kurt Haller using the canonical formalism. In addition, the Faddeev–Popov form for the Feynman gauge and temporal gauge Lagrangian path integrals are derived from the Hamiltonian form of the path integral. (shrink)

The practice of clinical mental health counseling benefits from the integration of a Catholic Christian meta-model of the person. This paper will briefly define and describe a paradigm that guides the practice of clinical mental health counseling. It will then demonstrate how a Catholic Christian view of the person aligns with and extends the dimensions of the practice paradigm resulting in a deeper understanding for the conceptualization of both presenting clinical concerns and their respective treatment. After describing an integrated model (...) for professional practice, two brief case studies will illustrate its application. In this paper we examine Fehr’s notions of “altruism”, “strong reciprocity” and “altruistic punishment” and query his ascription of altruism. We suggest that, pace Fehr, altruism cannot be defined behaviourally because the definition of altruism must refer to the motives of actors. We also advert to certain inconsistencies in Fehr’s usage of his terms and we question his explanation of altruism in terms of ‘social preferences’.

In this essay, I survey egalitarian and utilitarian approaches to the distribution of scarce life-saving medical resources. In my view, the major criterion for the distribution of scarce life-saving medical resources should be life expectancy: we should distribute life so as to maximize life-years. In Section II, I discuss the life-year maximization approach and situate it within utilitarian theory.

What makes inheritable genetic modification attractive is not its ability to treat disease, but its capacity, someday, to enhance human traits beyond what mere good health requires. But, these discoveries will not be imposed on us by government, as Huxley thought. If they take over our lives, it will be because they were sold to us on the open market, as commodities we cannot do without.

When it comes to the establishment of an ethical corporate culture, there appear to be at least two inter-related foundational requirements: (1) the existence of an explicit set of core ethical values; and (2) the presence of ethical leadership, i.e., an ethical ‘tone at the top.’ Some companies appear, however, to have been more successful than others when it comes to establishing an appropriate ‘tone at the top’, i.e., leaders who behave according to an explicit set of core ethical values.
